Privacy Policy
This privacy policy pertains to Flex Factor, a series of articulation agreements that provide ease in transferring credits from South Dakota technical institutes to South Dakota's public universities.

Your privacy is protected by the South Dakota Board of Regents, hereafter referred to as SDBOR. We only disclose your personal information to third parties where disclosure is permitted or required under law. Ordinarily, we do not disclose personal information to unaffiliated third parties, (1) unless the disclosure is necessary in order to obtain a third party service and the third party service provider agrees to safeguard its confidentiality, (2) unless required to do so pursuant to law or (3) unless the disclosure is required to protect the legal interests of the SDBOR.

Questions regarding this statement should be directed to Janelle Toman, South Dakota Board of Regents, 306 E. Capitol Ave., Suite 200, Pierre, SD, 57501, (605) 773-3455, janellet@sdbor.edu. To understand SDBOR's information practices when you visit our site at http://www.flexfactor.info, please read our privacy policy below.

What types of information does the SDBOR collect?
We collect personal information when you register with our site. This information allows us to learn more about you, and further refine the Flex Factor program.

Personal information includes your name, address, email address and education history. This information is considered personally identifiable and will not be displayed on our site.

We collect and store certain technical and other information about the online activities of our users - whether or not they are registered - on an aggregated (or collective) basis. This includes your IP address, browser type, and operating system. SDBOR does not use this information to identify you. We do, however, track the number of people who view each page, and other site usage data, in order to learn which features are the most popular and thereby improve our service. If you send an email or submit any information to our customer support staff, we will retain your email or other information for the time necessary to respond to you.

How does SDBOR use my information?
SDBOR uses the information you voluntarily give us to better understand who you are and to provide you with better service.

SDBOR may use your email address to send personalized e-mails to you from the SDBOR or its affiliates. Your e-mail address will not be sold to unaffiliated third parties. All other private information submitted by you is confidential and ordinarily will not be disclosed (1) unless the disclosure is necessary in order to obtain a third party service and the third party service provider agrees to safeguard its confidentiality, (2) unless required to do so pursuant to law or (3) unless the disclosure is required to protect the legal interests of the SDBOR.

How does SDBOR keep my information secure?
Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while we strive to protect your personal information, SDBOR cannot ensure or warrant the absolute security of any information you transmit to us. Once we receive your transmission, we make our best effort, including the use of firewalls, to ensure the security of your information on our systems.

Changes to the SDBOR Privacy Policy
This policy may change from time to time. If we make any material changes to the policy in the future with regard to how we use your information, we will notify you on our homepage.

What if I'm a resident outside of the U.S.?
Like almost every Web site, Flex Factor may be accessed by an international audience. By visiting our Web site and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this policy. In addition, such data may be stored on servers located outside your resident jurisdiction, which may have less stringent privacy practices than your own. By providing us with your data, you consent to the transfer of such data.

What else should I know about my privacy?
Ultimately, you are solely responsible for maintaining your personal information. Please be careful and responsible whenever you're online. The few SDBOR employees who have access to personal data are trained to comply with the above privacy policy and made aware of any updates or modifications.
